Some Statutes May Allow for Fee Recovery Without a Retention Agreement; To Avoid Litigating the Issue, Attorneys Should, at a Minimum, Advise All Interested Parties of Their Entitlement
The decision in In re Estate of Wong (2012) 207 Cal.App.4th 366 revealed the extent an attorney had to go to recover fees which were concededly earned, but not specified in a fee agreement. Compensation for “ordinary services” rendered to the executor of an estate is governed by Probate Code section 10810 et seq.
