Just when arbitrators and litigators were getting proficient with the arbitration process, along comes Zoom, which is here to stay. Now is the time to learn best practices concerning the substantive, procedural and technical issues raised when you conduct a virtual arbitration hearing via a videoconference platform such as Zoom. Can counsel meet privately with clients during a break, or does that have to be done via phone or e-mail? Is Zoom sufficiently secure to protect the confidentiality of the proceeding? How do you handle rebuttal exhibits when no two people are in the same room? Are there ways for the arbitrator or panel to really assess the credibility of a witness, including whether they are being coached? Written materials will be provided, including a draft Order covering a virtual arbitration hearing.
