The Labor Commissioner is a powerful and effective forum for resolving wage and hour disputes. With over twenty years of experience at the State Labor Commissioner’s office, Mr. Locker will discuss the anatomy of a Labor Commissioner claim, including:
• The Wage Claim – Framing the issues clearly and concisely;
• The Pre-Hearing Conference – Using the conference to discover information about your opponent’s case, attempt to reach a settlement, or convince the deputy to proceed (or not proceed) with the claim;
• The Administrative Subpoena – Making the most of limited discovery rights; and
• The Hearing - Effectively presenting your case to the hearing officer.
Mr. Locker will also discuss which penalties are recoverable, which are not recoverable (including new liquidated damages) and attorneys’ fees for expense reimbursements; how the Labor Commissioner decides to take cases, which cases it won't take; and how to appeal your case to the Superior Court.
