Johanna S. Schiavoni is a Partner with Jacobs & Schlesinger LLP. Johanna’s practice focuses on complex litigation, with a specialty in state and federal court appellate litigation. She has handled a variety of complex appellate and trial proceedings covering a broad spectrum of legal issues. She has extensive experience handling appeals for parties directly involved in litigation or parties seeking to file amicus curiae (“friend of the court”) briefs in other pending appeals. She also works with trial counsel and provides strategic counseling on a variety of trial practice and appellate litigation matters, particularly in class action cases. Johanna regularly handles appeals in both the Ninth Circuit and California Courts of Appeal.

In the business litigation arena, Johanna’s experience includes California business torts, employment matter, contracts, privacy, healthcare law, constitutional law, civil procedure issues, patents, copyrights, trademarks, trade dress, trade secrets, unfair competition, commercial fraud, insurance, securities, regulatory and administrative law issues, ethical compliance, and employee pension matters, and claims against public entities. Johanna also has significant experience litigating California consumer class actions at the trial and appellate levels.

In the criminal and immigration arenas, Johanna has litigated juvenile delinquency matters, habeas claims under the Anti-Terrorism and Effective Death Penalty Act (AEDPA), Sixth Amendment jury trial and sentencing issues, Fourth Amendment search and seizure issues, Eighth Amendment claims for medical treatment, and various immigration claims, including asylum, cancellation of removal, and claims of fraud and ineffective assistance of counsel.

Johanna’s appellate experience includes drafting appellate briefs, writ petitions and petitions for review; drafting amicus briefs and amicus letters; arguing appeals before state and federal appellate courts and federal agencies; reviewing the trial record and strategizing issues to raise on appeal; advising trial counsel regarding record and issue preservation in anticipation of appeal; and providing strategic counseling to trial and appellate lawyers regarding trial, post-trial and appellate matters.

Johanna has experience handling commercial cases at the trial level, which assists her considerably as she strategically prepares an appeal and counsels trial attorneys on various issues relating to trial and appeal. Her experience includes managing large scale discovery; drafting dispositive pre-trial motions, trial motions, and jury instructions; drafting Markman briefing (for claim construction in patent cases); taking and defending depositions; preparing witnesses for deposition and trial testimony; examining witnesses at trial; and drafting post-trial motions.

Before joining her current firm, she was an associate with Latham & Watkins LLP for more than six years, spending three years in that firm’s New York office, three years in its San Diego office and several months in the Los Angeles office.

Johanna also completed two judicial clerkships. From 2006 to 2007, she served as a law clerk to the Honorable M. Margaret McKeown on the U.S. Court of Appeals for the Ninth Circuit. From 2002 to 2003, she clerked for the Honorable Christina A. Snyder in the U.S. District Court for the Central District of California.

While in law school, Johanna served as a judicial extern for the Honorable Alex Kozinski, now Chief Judge of the U.S. Court of Appeals for the Ninth Circuit. She also taught an undergraduate law course as a University Teaching Fellow at UCLA.
