This interactive seminar will focus on primary and excess carrier obligations to settle construction defect claims, including a discussion of what makes a settlement demand “reasonable,” what constitutes an opportunity to settle within policy limits, and exceptions to the excess judgment requirement. Other topics the panel will address include whether and the extent to which an insurer can take coverage considerations into account in evaluating a settlement offer, circumstances in which an insured can settle a third party claim without carrier consent, stipulated judgments between the insured and third party claimant, and the effect of settlement without carrier consent in subsequent coverage litigation.
